DMCA Copyright Policy
Pumpkin Bread ("we", "us", "our") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), the text of which can be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, we will respond expeditiously to claims of copyright infringement committed using the Pumpkin Bread service and/or website (the "Service") if such claims are reported to our Designated Copyright Agent identified below.
Filing a DMCA Infringement Notice
If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Service by completing the following DMCA Notice of Alleged Infringement and delivering it to our Designated Copyright Agent.
- Identification of the copyrighted work claimed to have been infringed: Provide a description of the copyrighted work that you claim has been infringed, or if multiple copyrighted works are covered by a single notification, a representative list of such works.
- Identification of the infringing material: Provide a description of the material that you claim is infringing and where it is located on the Pumpkin Bread Service, with sufficient detail so that we may find it. For example, a direct URL to the infringing content.
- Contact information of the complaining party: Include your full legal name, mailing address, telephone number, and email address.
- Statement of good faith belief: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- Statement of accuracy and authorization: A statement, made under penalty of perjury, that the information in the notification is accurate, and that you are the copyright owner or are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Electronic or physical signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
Filing a DMCA Counter-Notification
If you believe that your content was removed or disabled by mistake or misidentification, you may file a counter-notification with us by providing our Designated Copyright Agent with the following information:
- Identification of the removed material: Identify the specific URLs or other unique identifying information of the material that Pumpkin Bread has removed or to which Pumpkin Bread has disabled access.
- Statement under penalty of perjury: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your contact information: Your name, address, telephone number, and email address.
- Statement of consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are outside of the U.S., for any judicial district in which Pumpkin Bread may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
- Your electronic or physical signature: Your physical or electronic signature.
